When does a 20 year patent turn out to be more than a 20 year patent... Patent Term Adjustments.

Okay, so under certain situations, an extension can be requested to the 20 years that the US has for patent applications after 1995. The idea is that for such applications as pharma the long lead time in all approvals through the PTO and the FDA and more... can significantly reduce the useful life of the patent. So Patent Term Adjustments, PTA, (not to be confused with when your parents got together with teachers and the principal), are sometimes allowed. This is the reason that your friendly Patent Attorney will usually say "a patent is the arrangement with the government to offer a monopoly on your invention for about 20 years when you disclose the invention in the formal patent process".

Okay, so PTAs are sometimes allowed, but the extensions can be very qwerty. In this case, you would think that the term adjustments to the main, parent, application would be afforded to the patent applications associated with dividing that original application. Not so, it would seem.

Ovshinsky is compared to Edison as a prolific inventor... He hold patents on NiMH batteries. His solar cells power the MIR space station.

Good question on Cobasys and the restrictions on next-gen batteries by the patents held within the company.!:-) The batteries that have become so critical in the next generation of batteries, electric cars, etc. are subject to patents by Ovshinsky (and the Cobasys company).

Cobasys is a 50/50 joint venture with Chevron/Texico and Ovonics. Ovonics has the Stan Ovshinsky inventions and GM now has a big ownership stake in that company.

So let's see, a BIG oil and a BIG auto have a BIG stake in the very batteries that make an electric car viable.

Look at "Patent encumbrances" at Wikipedia. The discussion on "Who Killed the Electric Car?" seem far truer than I ever imagined. This whole topic requires a lot more reading. But before picking up the thread again, I want to watch the movie.

Anybody out there have big ideas (substantiated by facts, I hope) on the issue.

So, as the Patent Wars start to heat up, like nothing that has ever gone before... The weird and wacky step out into space to duke it out.

It's gonna definitely get ugly as you have Google buying Motorola mobile for its production capacity and it's war chest of some 1,600 telcom-type patents. GoogaZilla, or Moto-oogle will be able to take on the likes of Apple and MicroSkype, now.

Rumor has it that Apple will buy up ARM Holdings for its patents, even though it already licenses them. ARM owns more than a hand-full of key smart phone patents.

In the end, we could have only a few companies that own, or have exclusive rights to, most of the patent technology in the know universe.

In the end, an you may have to go to another world or another universe to be able to operate freely in the patent-protected tech world that's evolving. When you get there, you may well find Samsung knocking loudly at the PoD Door. Whatever you do, don't let 'em in!
